1. Our Role – Family-Run Brokerage

Aafno Ghar ("we," "us," or "our") is the real estate brand of Bhim & Gita Group Private Limited, a family-run property brokerage based in Siliguri. Unlike an open listing marketplace, every property shown on this site has been personally sourced, visited and handled by our own team — the public cannot self-publish a listing here.

Even so, Aafno Ghar does not:

• Own any property listed on the site (unless separately and explicitly stated to you in writing)
• Collect booking amounts, token money, or sale consideration on behalf of an owner, except where we tell you in writing that we are doing so for a specific transaction
• Guarantee the availability, condition, title, or legality of any property beyond the checks we represent to you in writing for that listing

Any sale agreement is between the buyer and the property owner. Where Aafno Ghar acts as the sourcing brokerage for a transaction, our role and any fees are disclosed to you directly and in writing before you proceed — always conduct your own independent due diligence, including title verification, before making any payment.

2. General Disclaimer

The information provided on Aafno Ghar (the "Platform") is for general informational purposes only. While we strive to keep the Platform operational and useful, we make no representations or warranties of any kind, express or implied, about the completeness, accuracy, reliability, suitability, or availability of the Platform or any information, listings, products, services, or related content contained on the Platform for any purpose.

Any reliance you place on information found on this Platform is strictly at your own risk. Aafno Ghar expressly disclaims all liability for any loss or damage — including without limitation, indirect, incidental, special, consequential, or punitive loss or damage — arising from your use of, or inability to use, this Platform or any content found on it.

The Platform may be temporarily unavailable due to maintenance, technical issues, or circumstances beyond our control. We do not guarantee uninterrupted access to the Platform.

3. No Warranty

The platform is provided on an "as is" and "as available" basis without any warranties of any kind, either express or implied, including but not limited to:

• Warranties of merchantability, fitness for a particular purpose, or non-infringement
• Warranties that the Platform will be uninterrupted, error-free, secure, or free of viruses or other harmful components
• Warranties regarding the accuracy, completeness, or timeliness of any listing, price, or content
• Warranties that any defects or errors will be corrected
• Warranties that the Platform or its servers are free of malicious code

You are solely responsible for implementing sufficient security measures and procedures to satisfy your requirements for data protection and accuracy.

4. Listing Accuracy & Verification

Aafno Ghar does not independently verify the accuracy, completeness, or legality of any listing posted by sellers, property owners, or their representatives. Listing information — including but not limited to property descriptions, photographs, amenities, sale prices, title status, seller identity, and property addresses — is provided solely by the listing party and has not been independently verified by Aafno Ghar.

We strongly encourage all users to:

• View the property in person before signing any sale agreement or making any payment
• Verify the seller's identity and legal right to sell the property, including a title search
• Confirm that the property matches the listing description before committing
• Never send money, advances, or fees before viewing the property in person
• Use a written, registered sale agreement for all property transactions
• Consult a legal professional if you have any doubts about a listing or agreement

Aafno Ghar reserves the right, but is not obligated, to investigate any listing reported as fraudulent, inaccurate, or in violation of our Terms of Service.

5. User Responsibility

By accessing or using the Platform, you acknowledge and agree that:

• You are solely responsible for all decisions you make based on information found on the Platform
• You are solely responsible for verifying the accuracy and legitimacy of any listing before acting on it
• You are solely responsible for any sale agreement, payment, or transaction you enter into as a result of using the Platform
• You will not use the Platform for any unlawful purpose or in violation of any applicable laws or regulations
• You will not post false, misleading, fraudulent, or illegal listings
• You will not impersonate any person or entity or misrepresent your affiliation with any person or entity
• You accept full responsibility for any content you submit to the Platform, including listings, photos, and contact information

Sellers who post listings on Aafno Ghar represent and warrant that they have the legal right to sell the listed property, that all listing information is accurate and not misleading, and that the listing complies with all applicable laws, including but not limited to the Real Estate (Regulation and Development) Act, 2016 (RERA) and all applicable West Bengal and municipal regulations.

6. Affiliate Disclosure

Affiliate links and partnerships may appear on listing pages, blog posts, the Help Center, and other areas of the Platform. We identify affiliate relationships where required by applicable law and regulation, including the Consumer Protection Act, 2019 and other applicable Indian advertising and disclosure guidelines.

Our editorial content and listing rankings are not influenced by affiliate relationships. We only recommend services we believe provide genuine value to our users.

Affiliate partners may include, but are not limited to: moving companies, home insurance providers, legal and documentation services, interior/home services, and other property-related businesses.

Aafno Ghar may also earn revenue from promoted or "boosted" listings, where sellers pay a fee to have their listing displayed more prominently. Boosted listings are clearly identified with a badge on the listing card.

7. Third-Party Links & Services

The Platform may contain links to third-party websites, services, or resources that are not owned or controlled by Aafno Ghar. We have no control over, and assume no responsibility for, the content, privacy policies, terms of service, or practices of any third-party websites or services.

The inclusion of any link on the Platform does not imply endorsement, sponsorship, or recommendation by Aafno Ghar of the linked site or its content. We strongly advise you to read the terms and conditions and privacy policy of any third-party website you visit.

Aafno Ghar shall not be liable for any loss or damage arising from your use of any third-party website or service linked from the Platform.

8. Not Professional Advice

Nothing on Aafno Ghar constitutes legal, financial, real estate, tax, insurance, or any other professional advice. All content on the Platform — including blog posts, guides, articles, FAQs, and listing descriptions — is for general informational purposes only and should not be relied upon as a substitute for professional advice tailored to your specific circumstances.

9. Fraud Warning

Common property scams to watch for:

• Listings with prices significantly below market value for the area
• Sellers who claim to be abroad, travelling, or otherwise unable to show the property in person
• Requests for a token amount, advance, or any deposit before you have viewed the property in person and verified ownership documents
• Pressure tactics urging you to act immediately or "lose the deal"
• Requests for payment via untraceable methods (wire transfer, cryptocurrency, gift cards)
• Sellers who refuse to provide clear title documents or a written sale agreement
• Listings with stock photos or photos that appear to be copied from other websites
• Sellers who ask for sensitive personal information (Aadhaar, PAN, banking details) before a viewing

If you encounter a suspicious listing, please report it immediately using the "Report" button on the listing page or by submitting a support ticket at our Help Center. You may also report property fraud to India's National Cyber Crime Reporting Portal at cybercrime.gov.in.

Aafno Ghar is not liable for any losses arising from property fraud or scams perpetrated by third parties using our Platform.

10. Content Removal Rights

Aafno Ghar reserves the absolute right, at our sole discretion and without prior notice, to:

• Remove, edit, or suspend any listing or content that we determine, in our sole judgment, violates our Terms of Service, this Disclaimer, or any applicable law
• Remove any listing reported as fraudulent, misleading, discriminatory, or otherwise harmful
• Suspend or terminate the account of any user who violates our policies
• Refuse to publish any listing or content submitted to the Platform
• Modify, suspend, or discontinue any feature or aspect of the Platform at any time

We are not obligated to provide reasons for content removal or account suspension. The exercise of these rights does not create any liability on the part of Aafno Ghar toward any user, seller, or third party.

11. Indemnification

By using the Platform, you agree to defend, indemnify, and hold harmless Aafno Ghar, its parent company, subsidiaries, affiliates, officers, directors, employees, contractors, agents, licensors, and successors (collectively, the "Aafno Ghar Parties") from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or relating to:

• Your use of or access to the Platform
• Any listing, content, or information you submit to the Platform
• Your violation of this Disclaimer, our Terms of Service, or any applicable law or regulation
• Your violation of any third party's rights, including intellectual property rights, privacy rights, or contractual rights
• Any sale transaction, agreement, or dispute arising from your use of the Platform
• Any fraudulent, misleading, or illegal activity you engage in through or in connection with the Platform
• Any claim by a third party arising from your listing, content, or conduct on the Platform

Aafno Ghar reserves the right, at its own expense, to assume the exclusive defence and control of any matter subject to indemnification by you, in which case you agree to cooperate fully with Aafno Ghar in asserting any available defences.

12. Limitation of Liability

To the maximum extent permitted by applicable law, the Aafno Ghar parties shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including without limitation:

• Loss of profits, revenue, data, goodwill, or other intangible losses
• Losses arising from fraudulent, inaccurate, or misleading listings posted by third parties
• Losses arising from disputes, disagreements, or legal proceedings between buyers and sellers
• Losses arising from your reliance on any information, listing, or content on the Platform
• Losses arising from unauthorized access to or use of our servers or any personal information stored therein
• Losses arising from any interruption, suspension, or termination of the Platform
• Losses arising from any bugs, viruses, or other harmful code transmitted through the Platform
• Losses arising from any sale transaction, payment, or agreement entered into as a result of using the Platform

In no event shall Aafno Ghar's total aggregate liability to you for all claims arising out of or relating to your use of the Platform exceed the greater of: (a) the total amount you paid to Aafno Ghar in the twelve (12) months immediately preceding the claim; or (b) ₹8,000.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for incidental or consequential damages. Accordingly, some of the above limitations may not apply to you. In such jurisdictions, Aafno Ghar's liability shall be limited to the fullest extent permitted by applicable law.

13. Governing Law & Jurisdiction

This Disclaimer and any dispute arising out of or relating to your use of the Platform shall be governed by and construed in accordance with the laws of West Bengal and the applicable federal laws of India, without regard to conflict of law principles.

You agree that any legal action or proceeding arising out of or relating to this Disclaimer or your use of the Platform shall be brought exclusively in the courts of competent jurisdiction located in Siliguri, West Bengal, India. You hereby irrevocably consent to the personal jurisdiction of such courts and waive any objection to the laying of venue in such courts.

If you are accessing the Platform from outside India, you are responsible for compliance with all local laws applicable to your use of the Platform.

14. Severability

If any provision of this Disclaimer is found by a court of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, that provision shall be modified to the minimum extent necessary to make it enforceable, or if modification is not possible, it shall be severed from this Disclaimer. The remaining provisions of this Disclaimer shall continue in full force and effect.

The failure of Aafno Ghar to enforce any right or provision of this Disclaimer shall not constitute a waiver of that right or provision.

15. Changes to This Disclaimer

Aafno Ghar reserves the right to modify, update, or replace this Disclaimer at any time and at our sole discretion. We will indicate the date of the most recent update at the top of this page.

Your continued use of the Platform after any changes to this Disclaimer constitutes your acceptance of the revised Disclaimer. If you do not agree to the revised Disclaimer, you must immediately stop using the Platform.

We encourage you to review this Disclaimer periodically to stay informed of any updates. For material changes, we may provide additional notice through the Platform or by email where we have your contact information.

16. Privacy & Data Protection Compliance

Aafno Ghar is committed to protecting the privacy of our users in accordance with the Digital Personal Data Protection Act, 2023 (DPDP Act) and other applicable Indian privacy law.

We collect, use, and disclose personal information only for the purposes described in our Privacy Policy. By using the Platform, you consent to the collection, use, and disclosure of your personal information as described in our Privacy Policy.

Sellers who post listings on the Platform are responsible for ensuring that any personal information they collect from prospective buyers (including contact information and identification details) is collected, used, and stored in compliance with the DPDP Act and all applicable privacy laws.
