1. Acceptance of Terms

By accessing or using Aafno Ghar ("the Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Platform.

These Terms apply to all users of the Platform, including buyers, property owners, and visitors.

2. Platform Description

Aafno Ghar is the real estate brand of Bhim & Gita Group Private Limited, a family-run property brokerage based in Siliguri, West Bengal. Rather than an open marketplace where anyone can post a listing, we personally source, visit and handle every property shown on this site. Owners looking to sell privately can reach us through our "Sell With Us" enquiry — this is not a public listing.

3. User Accounts

To post listings or access certain features, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain the security of your password and account
• Notify us immediately of any unauthorized use of your account
• Be responsible for all activity that occurs under your account
• Not create accounts for others without their permission

We reserve the right to suspend or terminate accounts that violate these Terms.

4. Listing Rules & Prohibited Content

When posting a listing, you agree that your listing will:

• Be accurate, truthful, and not misleading
• Relate to a real property that you have the right to list
• Comply with all applicable laws, including the Real Estate (Regulation and Development) Act, 2016 (RERA) and West Bengal's applicable real estate regulations
• Not discriminate based on race, gender, religion, disability, or any other protected characteristic

Prohibited listings include:

• Fraudulent, fake, or scam listings
• Properties you do not have authority to list
• Listings that violate any applicable law
• Duplicate listings for the same property
• Listings with misleading photos or descriptions

We reserve the right to remove any listing that violates these rules without notice.

5. Buyer Obligations

As a buyer using Aafno Ghar, you agree to:

• Contact sellers only for genuine purchase inquiries
• Not harass, spam, or abuse sellers or other users
• Verify the legitimacy of any listing before making any payment
• Never send money via wire transfer, cryptocurrency, or gift cards to a seller you have not met in person and verified
• Independently verify title, encumbrances, and property documents before making any advance or booking payment
• Report suspicious listings using our reporting tools

6. Property Owner Obligations

If you submit a property to us through "Sell With Us," you agree to:

• Only submit properties you own or have legal authority to sell
• Respond to our team in a timely manner during valuation and enquiry follow-up
• Comply with all applicable property and real estate laws, including RERA/WBRERA where applicable
• Not discriminate against prospective buyers
• Tell us promptly when a property is no longer available so we can take it off our books
• Provide accurate information about the property, including any known defects, encumbrances, or title issues

7. Affiliate Links & Third-Party Services

Aafno Ghar may display links to third-party services (movers, insurance providers, etc.) through our affiliate program. We may earn a commission when you use these services. This is disclosed on all relevant pages.

We are not responsible for the content, quality, or practices of third-party services. Your use of any third-party service is governed by that service's own terms and privacy policy.

8. Intellectual Property

The Aafno Ghar name, logo, design, and platform code are owned by Aafno Ghar and protected by copyright and trademark law. You may not use our brand assets without written permission.

By posting content (listings, photos, descriptions) on the Platform, you grant Aafno Ghar a non-exclusive, royalty-free license to display, distribute, and promote that content on the Platform and in marketing materials.

You retain ownership of all content you post. You represent that you have the right to post such content and that it does not infringe any third-party rights.

9. Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. Aafno Ghar DOES NOT WARRANT THAT:

• The Platform will be uninterrupted or error-free
• Any listing is accurate, complete, or legitimate
• Any seller or buyer is who they claim to be
• The Platform will meet your specific requirements

You use the Platform at your own risk. Always conduct your own due diligence — including title verification — before entering into any sale agreement.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, Aafno Ghar SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE PLATFORM, INCLUDING BUT NOT LIMITED TO:

• Losses arising from fraudulent listings
• Disputes between buyers and sellers
• Loss of data or business interruption
• Any sale agreement entered into through the Platform

Our total liability to you for any claim shall not exceed ₹8,000.

11. Termination

We may suspend or terminate your access to the Platform at any time, with or without notice, for any reason, including violation of these Terms. You may terminate your account at any time by contacting us.

Upon termination, your right to use the Platform ceases immediately. Provisions that by their nature should survive termination will survive.

12. Governing Law

These Terms are governed by the laws of West Bengal and the applicable federal laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts of Siliguri, West Bengal.

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
